The USDA Animal and Plant Health Inspection Service (APHIS) Lacey Act Phase VI implementation took effect on Oct. 1. At this time, Customs and Border Protection (CBP) has not loaded PGA flags into ACE. Customs brokers are still under the obligation to transmit the Lacey Act data set for goods subject to the new requirements.
NCBFAA encourages customs brokers to continue to query the affected HTS numbers as CBP may make the information available shortly.
It is noted that all pallets will be flagged as an AL2. Should you have a shipment of used pallets or pallets (new or used) being declared separately on your entry which is “under load,” please use disclaim code “B”. This will allow you to proceed with your entry without the need to file further Lacey’s information.
