In accordance with the provisions outlined in the General Notice (88 FR 48900) published on July 28, 2023, there are upcoming changes to specific customs user fees and their associated limitations, as detailed in 19 U.S.C. § 58c. These adjustments are slated to become effective on October 1, 2023, in compliance with the Fixing America’s Surface Transportation Act of 2015 (FAST Act), Public Law 114-94. It is essential to note that the ad valorem rate for the Merchandise Processing Fee (MPF), set at 0.3464%, will remain unchanged. However, there will be modifications to the minimum and maximum MPF fees for formal entries (class code 499). Specifically, the minimum will increase from $29.66 to $31.67, while the maximum will rise from $575.35 to $614.35.
Several other fees are also undergoing adjustments:
- The Surcharge for Manual, Formal Entry/Release (class code 500) will be revised to $3.80.
- The fee for Informal Entry/Release, automated and not prepared by CBP personnel (class code 311a), will shift to $2.53.
- The Express Consignment Carrier/Centralized Hub Facility fee will change to $1.27 per individual waybill/bill of lading. Please refer to 82 FR 50523 (Nov. 1, 2017), for further clarification on individual air waybills.
- The Commercial Vessel (class code 485) or Commercial Aircraft (class code 495) Passenger Arrival customs fee will be adjusted to $6.97 per passenger.
- The Commercial Vessel Passenger Arrival from Exempt Areas (class code 484) customs fee will undergo a change to $2.44 per passenger.
- The Commercial Truck Arrival fee (class code 492) will be modified to $6.95. It is important to note that this fee solely represents the CBP fee and does not include the United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) Agricultural and Quarantine Inspection (AQI) Services Fee, which currently stands at $7.29. The CBP collects this fee on behalf of the USDA, resulting in a total single crossing fee of $14.24. After eighteen Single Crossing Fees have been paid and applied to a vehicle identification number (VIN)/vehicle in a Decal and Transponder Online Procurement System (DTOPS) account within a calendar year, the payment required for the nineteenth (and subsequent) single crossing will consist solely of the AQI fee, currently set at $7.29. CBP’s $6.95 Commercial Truck Arrival fee will no longer be applicable for the remainder of that calendar year.
- The Dutiable Mail fee (class code 496) will be adjusted to $6.97.
