Customs and Border Protection (CBP) has released updated guidance on products exempted from reciprocal tariffs, following a Sept. 5 executive order modifying the scope of earlier trade measures.
The update affects merchandise covered under Executive Order 14257, originally issued in April to impose reciprocal tariffs on a wide range of imports. The Sept. 5 order adds and removes items from Annex II, which specifies products eligible for exemptions.
According to CBP, the changes apply to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. ET on Sept. 8. Only products properly classified under the Harmonized Tariff Schedule of the United States (HTSUS) headings listed in the updated Annex II are eligible for exemption.
Importers are instructed to report the secondary classification under subheading 9903.01.32 when declaring qualifying products. For pre-filed entries submitted prior to Sept. 8, CBP advised importers to correct filings within ten days of cargo release if affected items have been added or removed from Annex II.
The Sept. 5 executive order also authorizes the Commerce Secretary and U.S. Trade Representative to determine further exemptions as part of framework or final trade and security agreements. Additional updates may be issued as new agreements are finalized.
