CBP Responds to Customs Broker Inquiries Regarding Courtesy Form Copies

If you are a customs broker, and have not been receiving Customs and Border Protection (CBP) forms 28, 29, 4647 to your Automated Commercial Environment (ACE) Secure Data Portal Accounts, there is a good reason. 

CBP has stated that customs brokers have been reporting they’re not receiving these forms that are “Request for Information”, “Notice of Action”, and “Notice to Mark/Notice to Re-Deliver” respectively. If you have not been receiving these forms to your Secure Data Portal Accounts after the April 23rd ACE Forms Modernization distribution, it is because the settings have changed. 

CBP has announced it will be publishing a message clarifying that the legacy ACE Portal Forms capability as well as the new ACE Forms Modernization Application work as intended to deliver electronic CBP forms 28, 29, and 4647 to importer ACE Portal Accounts only – not to customs broker ACE Portal Accounts. 

To clarify, while it is possible for customs brokers to receive a courtesy copy of the CBP Forms 28, 29, 4647 and have them delivered to an importer’s ACE Portal Accounts via email, it is not guaranteed unless it is enabled in the “Portal” setting under the “Mode of Communication” portlet. This will need to be set for both importer and customs broker to receive the messages in their ACE Portal Accounts.

If the importer has linked all their Importer of Record (IOR) numbers to their ACE Portal Account’s Top Account record, and the customs broker has provided an email address with the Primary Point of Contact record in the sub-account level of the custom broker’s ACE Portal Account, both will receive the CBP forms 28, 29, 4647. 

This setting must be selected to said emails in order for them to receive these forms. If it is not, then the courtesy copy of these forms will not be received.
