81 COVID exclusions, that include medical care products, to the Section 301 Trade investigation were set to expire on November 30, 2022. The Office of the US Trade Representative announced that those exclusions will be extended by three months, through February 28, 2023.
The exclusion extensions are available for any product that meets the specified HTSUS numbers and product descriptions, regardless of whether the importer filed an exclusion request. U.S. Customs and Border Protection will issue instructions on entry guidance and implementation. USTR has indicated that it may continue to consider further extensions and/or additional modifications as appropriate.
“In light of the continuing efforts to combat COVID, the U.S. Trade Representative has determined that a 3 month extension of the 81 COVID related product exclusions is warranted,” the USTR said in a release to the Federal Register. USTR also said the decision “ took into account previously submitted public comments, advice from advisory committees and the interagency Section 301 Committee, and the White House COVID-19 Response Team.”
