In a Federal Register notice released August 24th, Customs and Border Protection (CBP) announced the names of hundreds of individuals that lost their customs broker licenses. This was due to them failing to file for their Triennial Status reports, which is required by law with the agency. Section 641 of the Tariff Act of 1930, as amended (19 U.S.C. 1641) and section 111.30(d) of title 19 of the Code of Federal Regulations (19 CFR 111.30(d)) is wherein the law that states these customs brokers “were revoked by operation of law, without prejudice, for failure to file a triennial status report.”
The list not only shows revoked customs brokers’ licenses, but presents the port which issued the licenses, and the names (be it individual or company) within the port whose licenses were revoked.
The 2021 Triennial Status Report has a period that closed on March 1st, and the federal law requires every licensed customs broker to file a status report with CBP on each third year and requires a $100 fee.
The CBP port/center director will send, by certified mail, a written notice to the customs broker in March of that same reporting year when the license is suspended. The customs broker may tender a status report and fees online, or at the port where the license was delivered within 60 days of the notice period. Should the status report and fee be submitted within those sixty days of notice suspension, the license is reinstated.
